These Terms and Conditions ("Terms") govern your use of our website, services, and the purchase of mining claims and consulting services through Kodiak Minerals, LLC. By accessing our website, engaging our services, or purchasing or accessing a mining claim, you agree to be legally bound by these Terms.

1. Services Provided

Kodiak Minerals, LLC provides:

  • Mining law consulting and advisory services.

  • Mining claim administration and maintenance services, including annual filings and compliance assistance.

  • Sale of federal mining claims with appropriate documentation and conveyancing support.

No Legal Representation

Nothing on this website constitutes legal representation or the establishment of an attorney-client relationship. While Kodiak Minerals provides mining law consulting, we do not provide legal advice or represent clients in court or before administrative agencies. Consultation services are for informational and strategic purposes only and do not constitute the practice of law. For legal representation, users should consult with a licensed attorney in their jurisdiction.

You must be at least 18 years old or the age of majority in your jurisdiction to purchase services or mining claims. Our sales and services are provided subject to availability, applicable laws, and our sole discretion.

2. Payment Terms

We accept payments for services and sales via:

  • ACH Bank Transfer

  • Credit/Debit Cards (processed through Stripe and PayPal)

  • PayPal

  • Mobile Payment Apps (such as Venmo, Cash App, etc.)

  • Cryptocurrency (BTC, ETH, USDC, or as otherwise specified) (subject to market conversion rates at the time of transaction)

  • Certified Funds (cashier’s checks or money orders)

All payments are due in full at the time of service engagement or upon the execution of a purchase agreement, unless otherwise agreed in writing.

​3. Refund and Guarantee Policies

3.1 30-Day Money Back Guarantee on Mining Claim Sales

Purchasers of mining claims from Kodiak Minerals, LLC are entitled to a 30-day money back guarantee under the following conditions:

  • The purchaser must execute a Quitclaim Deed or other appropriate instrument transferring all rights, title, and interest in the claim back to Kodiak Minerals, LLC.

  • The completed and notarized deed must be delivered to Kodiak Minerals, LLC within 30 calendar days of the purchase date.

  • Upon receipt and confirmation of the correctly completed deed, a full refund will be issued using the original form of payment, unless otherwise agreed.

3.2 Lifetime Money Back Guarantee for BLM Land Status Issues

Kodiak Minerals, LLC guarantees that should the Bureau of Land Management (BLM) declare any mining claim purchased from us "Void ab initio" due to a land status defect (e.g., the claim is invalid because the land is closed to mineral entry) that existed prior to your purchase:

  • The purchaser is entitled to a full refund of the original purchase price, irrespective of the time elapsed since the purchase.

  • The purchaser must provide official documentation from the BLM substantiating the "Void ab initio" determination.

  • The Company may require a deed re-conveying any remaining interest in the claim prior to issuing the refund.

  • Refunds will be issued using the original payment method or via another mutually agreed form of payment.

3.3 Refund Exclusions

Refund guarantees do not apply to:

  • Administrative, consulting, or maintenance services once rendered.

  • Failures to file annual maintenance fees or paperwork by the purchaser.

  • Issues arising from changes in federal or state mining regulations post-sale.

4. User Responsibilities

By engaging with Kodiak Minerals, LLC, you agree to:

  • Provide accurate, complete, and current information during purchases or service engagements.

  • Abide by all federal, state, and local mining laws when operating on any mining claim acquired.

  • Acknowledge that ownership of mining claims does not convey surface rights unless specified and must comply with land access regulations.

5. Payment Processing

Payments made via credit/debit card are processed securely through Stripe and PayPal. By submitting your payment information, you authorize us to charge the specified amount using your chosen payment method. We are not responsible for any fees or transaction charges imposed by your bank, credit card issuer, or payment processor. We do not store your payment card details on our servers. Payment via cryptocurrency may involve third-party wallet or exchange platforms, for which Kodiak Minerals, LLC assumes no liability.

6. Limitation of Liability

Kodiak Minerals, LLC does not guarantee the presence of valuable minerals on any mining claim sold or consulted upon. All mining activity is speculative by nature. Kodiak Minerals, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or the purchase of mining claims, including but not limited to:

  • Loss of money

  • Environmental hazards

  • Regulatory or legal obstacles

  • Personal or property injuries

  • Geological outcomes, mineral production, or economic viability of mining claims

  • Third-party actions, including BLM determinations or regulatory changes.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising out of or related to your use of this website.

 

Our total liability under these Terms is limited to the amount paid by you for the specific product or service giving rise to the claim.

Assumption of Risk and Release of Liability

Mining claims offered for sale by the Company are located in remote and potentially hazardous environments, including but not limited to mountainous regions, desert terrain, riverbanks, and wilderness areas that may be subject to extreme temperatures, rapid water flow, unstable ground, falling rocks, encounters with wildlife, and other inherent dangers.

By purchasing, visiting, or using any mining claim offered by the Company, you voluntarily assume all risks associated with entering and utilizing such land, including risks of injury, illness, permanent disability, or death resulting from prospecting, recreating, camping, hiking, traveling to or from the claim, or engaging in any activity on or near the property.

 

To the fullest extent permitted by law, Kodiak Minerals, LLC, its owners, officers, members, agents, affiliates, and representatives shall not be liable for any loss, injury, damage, or death to persons or property arising from or related to any use of, presence on, or activity conducted on any mining claim, whether by the purchaser, their guests, assignees, or any third party. This includes but is not limited to injuries caused by environmental conditions (e.g., extreme heat, flash floods, rough terrain, or wildlife), physical activity, use of equipment, or failure to exercise due caution.

 

You agree to indemnify, defend, and hold harmless Kodiak Minerals, LLC from any and all claims, liabilities, damages, losses, or expenses, including attorneys’ fees, arising out of or in any way connected with your access to or use of a mining claim.

 

The purchaser and any person accessing a claim do so at their own risk and are solely responsible for their own safety, preparedness, legal compliance, and knowledge of local environmental and land-use regulations. Claims may lack cell service, medical access, or maintained roads and are not insured or patrolled by the Company.

 

If you do not agree to this limitation of liability, you must not purchase or access any claim.

7. Taxes and Fees

Where property taxes are assessed and due for claims, purchasers are responsible for all property taxes. Customers are responsible for all other applicable taxes, transaction fees, and currency conversion costs imposed by federal, state, and local governments, financial institutions or payment processors.

8. Consulting and Administrative Services

Consulting and claim administration services are billed based on agreed rates or flat fees. These services are non-refundable once the service has been rendered or commenced, unless otherwise specified in a separate written agreement.

9. Ownership and Disclaimers

Kodiak Minerals, LLC conveys mining claims via Quitclaim Deed and makes no warranties or representations as to:

  • The existence, quantity, or quality of mineral deposits.

  • Economic viability or profitability of mining operations.

  • Accessibility, surface conditions, or suitability for prospecting.

All sales of mining claims are subject to applicable federal, state, and local laws, including compliance with BLM and county filing requirements.

10. Website Usage

Prohibited Conduct

You may not:
